Madras HC stays UGC restraint on distance education courses

With Madras High Court staying the UGC’s restraint on Bharathiar Unviersity on admitting students to its
distance education courses, the University today stated that the students can now now get admitted through
study centres outside the State.

University Grants Commission (UGC) had restrained the University here from admitting students to its distance education courses through Study Centres outside the state from the academic year 2015-16 onwards.

University Registrar Dr.K.G.Senthilvasan has submitted in the court that the University has been offering over 200 Under Graduate, Post Graduate courses,Diploma and Certificate courses through distance education mode
in accordance with the UGC guidelines, an official release said today.

The petitioner stated that through a communication dated August 27 and November 17, 2015, the UGC informed that the territorial jurisdiction of State Universities both private and government for offering programs in distance mode cannot go beyond the boundaries of the respective State and restrained the petitioner from admitting
students for the current academic year.

As per the Act and Statutes of the Bharathiar University it has ample powers to conduct these courses outside the State also without any restriction on jurisdiction.Stating that though they admit students from across the
country, admissions are made only in the university campus and only study centres are located outside the State, the petitioner sought an interim staya gainst the UGC’s order.

The Judge M.M.Sundaresh after hearing the arguments of V.Subbiah, Special Government Pleader and S.T.S Moorthy, Government Pleader has ordered stay of the UGC’s orders, the release said In view of this stay, the students, even outside the State, will be admitted to the courses, the release said.
